These terms and conditions ("Terms") govern the provision of services by CMek Design Studio ("CMek", "we", "us"), a creative design studio located in Sydney, NSW, Australia. By engaging our services, you ("client", "you", "your") agree to be bound by these Terms.

1. General Terms

1.1 Acceptance of Terms: All services provided by CMek are subject to these Terms, which constitute the entire agreement between CMek and the client.

1.2 Deposits: A non-refundable deposit is required before commencement of any project. Payment of the deposit signifies acceptance of these Terms and confirms the client's commitment to proceed with the project.

1.3 Cancellation: In the event of cancellation by the client due to a change of mind, the deposit paid is non-refundable.

2. Logo Design Services

2.1 Revisions: Logo design includes up to 3 rounds of revisions. Additional revisions will incur extra costs, which will be communicated to the client.

3. Website Design and Development

3.1 Scope: Website design and development services are based on the agreed scope of work.

​

3.2 Revisions: Up to 3 rounds of revisions are included in the initial scope. Additional revisions will be charged at our standard hourly rate unless otherwise agreed upon.

3.3 Changes: Any changes to the agreed scope of work may incur additional fees, which will be communicated and agreed upon prior to implementation.

4. Photography and Cinematography

4.1 Payment: The full amount for photography and cinematography services must be paid in advance of the shoot date.

5. Additional Terms

5.1 Website Changes: Any changes requested after the completion of the project scope may incur additional fees, unless otherwise discussed and agreed upon prior to implementation.

5.2 Additional Web Pages: If additional web pages are requested after the initial agreement, additional costs may apply at CMek's discretion.

5.3 Disputes: Any disputes arising from these Terms will be governed by the laws of New South Wales, Australia.

5.4 Client Responsibilities: The client agrees to provide timely feedback, materials, and approvals necessary for the timely completion of the project.

5.5 Intellectual Property: Upon full payment, CMek grants the client full rights to use the final deliverables for their intended purposes. CMek retains the right to showcase the work in portfolios and marketing materials.

6. Limitation of Liability

6.1 Indemnification: The client agrees to indemnify and hold CMek harmless against any claims, damages, or losses arising from the client's use of CMek's services.

​

6.2 Liability: CMek's liability for any claims arising out of or related to these Terms will not exceed the total amount paid by the client under the relevant project.

7. Modifications to Terms

7.1 Updates: CMek reserves the right to update these Terms from time to time. Updated Terms will be effective upon posting on our website or providing notice to the client.
